A West Texas district plans to sue the state over school funding

The Midland Independent School District is moving forward with a lawsuit against the state of Texas, arguing that the current school finance system is broken and unfair. School trustees voted Tuesday to take legal action, claiming the state's recapture program-often called "Robin Hood"-forces the district to send millions of dollars in local tax revenue to Austin, leaving them unable to adequately fund their own classrooms.

Under the recapture system, property-wealthy districts like Midland must send excess tax money to the state, which then redistributes it to poorer districts. Midland officials say they have almost no control over their local tax rates, yet they are penalized for having a high property tax base. The district estimates it will send roughly $40 million to the state this year alone, money they say should stay in the community to pay for teacher salaries, school safety, and facility upgrades.

Trustees argue that the system violates the Texas Constitution, which requires the state to provide an efficient and equitable system of public education. They claim the current setup creates a disincentive for local communities to invest in their schools, since any extra local revenue is quickly swept away by the state. The lawsuit is expected to challenge the constitutionality of recapture and seek a ruling that forces the legislature to overhaul the funding formula.

State officials have defended the recapture system as a necessary tool to balance funding across rich and poor districts. But Midland leaders say the system has become a burden that hurts students and property owners alike. The board's vote sets the stage for a legal battle that could have wide implications for school funding across Texas.
